FELONY DWI - MASSENA - Massena-based state police charged Elvis W. Pimentel, 31, of 260-49 75th Ave., Glen Oaks, currently working in Massena, with a felony count of driving while intoxicated and ticketed him for failure to keep right following a traffic stop at 2:10 a.m. Friday on County Route 42 in the town of Massena. He allegedly had a blood alcohol content of 0.17 percent. A blood alcohol content of 0.08 percent or higher is considered proof of intoxication in the state. The charge is elevated to aggravated DWI when the blood alcohol content is 0.18 percent or higher. Pimentel was charged with a felony since he had a prior conviction for a misdemeanor count of DWI within the past 10 years. He was reportedly convicted of DWI on Nov. 8, 2010 in Queens County Courth. He was arraigned by Massena Town Justice Gerald P. Sharlow and released on his own recognizance. The court suspended his operating privileges pending prosecution of his case. He was represented at his arraignment by St. Lawrence County Assistant Public Defender Robert Ballan under the county program that provides alleged offenders with an attorney at their initial felony arraignment.
