Angel’s Inn Adult Home to pay $22k fine, hopes for enhanced license

WATERTOWN — Angel’s Inn Adult Home owner Mary E. Allen most likely will have to pay the state Department of Health $21,975 in fines, after the home was cited with a handful of violations during a February inspection.

Her attorney, Anthony A. Marrone II, a long-term care and estate planning attorney at Menter, Rudin & Trivelpiece, Syracuse, said he and the department have been in negotiations about the fine throughout the past couple of months.

“They probably won’t go any lower than that,” he said. “She still has the option of going forward with a hearing.”

He said he has regular communication with the department, and there is no deadline for the hearing option. It is more likely, Mr. Marrone said, that Mrs. Allen will reluctantly pay the fine.

The 7,500-square-foot Pine Street adult home, which has the capacity to house up to 24 people in its 17 rooms, has had its share of state Department of Health violations and subsequent fines for many years. One of the last straws for Mrs. Allen involving failed administrative oversight stemmed from the February state inspection, which found numerous violations, mainly for lack of documentation and required policies.

All violations have been addressed through a required action plan, and Administrator Jerry R. Gundayao has drafted workplace policies.

“Most of the stuff, I think, Dr. Jerry is responding to now are structural or maintenance, not patient care,” Mr. Marrone said. “I think that the next task on my agenda is to finalize the application for enhanced licensure.”

With an enhanced license, Mrs. Allen would be able to provide a higher level of care for residents. Former violations include providing care for patients beyond what adult homes should offer. Mrs. Allen has said she cares deeply about each resident, and just wants to take care of them all.

An enhanced license should “alleviate a lot of the Department of Health pressure,” Mr. Marrone said.
