Theresa man acquitted of 2012 felony DWI charge

WATERTOWN — A Jefferson County Court jury Tuesday acquitted a Theresa man of a felony charge that he drove while intoxicated in 2012. Aaron J. Mercer, 32, whose last known address was 28312 Joyner Road, was found not guilty following a two-day trial of driving while intoxicated and having an uninspected motor vehicle. He was found guilty of failing to notify the Department of Motor Vehicles of an address change and was fined $150.

He was charged with DWI on Joyner Road on Oct. 29, 2012. Trial testimony said that state police were called to the area for reports of a domestic incident. A trooper testified that he saw Mr. Mercer about to pull out of his driveway onto the public road, but stop when he saw the trooper’s car. He pulled his vehicle back into his driveway, leaving the question of how many of his tires, if any, made contact with the road and whether the limited contact constituted operating a vehicle on a public highway, a requirement for a DWI charge.

He was represented by attorney Anthony M. Neddo.
