A Merrimack, N.H., man was charged with aggravated driving while intoxicated Saturday night after he allegedly was spotted by Jefferson County sheriffs deputies driving recklessly on Route 126 in the town of Rutland.
Shawn W. Colburn, 39, was stopped at 10:54 p.m. after he was seen failing to keep right and crossing the fog line, deputies said. According to the arrest record, he said he was driving back to this hotel in Carthage after having a few beers in Watertown.
After being taken to the Metro-Jefferson Public Safety Building, Mr. Colburn submitted to a breath test, which determined his blood alcohol content to be 0.21 percent. Under state law, a BAC of 0.08 percent or more constitutes proof of intoxication. Aggravated DWI is charged when the BAC is 0.18 percent or higher.
He was released to military custody pending an appearance in Rutland Town Court.
