Brushton woman files claim against Stewart’s

BRUSHTON — A Brushton resident is suing Stewart’s Shops for negligence after she tripped over bread crates in an aisle of the store in her hometown.

According to court documents filed last week at the Franklin County Clerk’s Office, Virginia Murphy “tripped over plastic bread crates that had negligently been placed on the floor, causing her to trip and fall, cutting her right leg.” She sustained “a laceration that required 22 stitches, causing the skin of the leg to necrose and slough off.”

The medical definition of the term “necrose” in this case, according to Taber’s Medical Dictionary, is “the death of cells.”

Ms. Murphy claims the incident left her with “a large open wound on her lower leg” as well as “protracted healing time and severe scarring,” according to court documents.

The incident occurred July 15, 2012, at Stewart’s, 1271 Washington St., Brushton. The lawsuit claims Stewart’s was negligent for leaving the bread crates “in an aisle meant for pedestrian traffic” and failing to warn customers to avoid them.

The complaint goes on to say that Ms. Murphy was “seriously and probably permanently injured” and “suffered great pain, inconvenience, mental anguish and expense” that did not allow her to go about her day-to-day life as usual.

She is represented by the firm Lekki Hill Duprey & Bhatt, which has law offices in Canton, Massena and Ogdensburg.
