CANTON Michael D. Durands sentencing in a burglary case was delayed for at least one more day after St. Lawrence County Court Judge Jerome J. Richards recused himself from the matter.
Durand, 30, Ogdensburg, was one of three men accused of murder in the unrelated death of an 83-year-old Ogdensburg man during a drug-related robbery on Nov. 18, 2010.
While Durand was exonerated in the murder case earlier this month, he remained jailed on the burglary case, in which he pleaded guilty to one count of third-degree attempted burglary on March 28, 2012.
Sentencing was adjourned on May 7, 2012, when he was placed on one year of interim probation.
Sentencing was set for Monday, but Judge Richards, who presided over the murder trial, recused himself following a bench conference with attorneys.
The reason for his recusal was not publicly disclosed, with the judge saying only that he could no longer keep to his previous sentencing commitment in the case.
The case was passed to Judge Kathleen M. Rogers, who was not scheduled to return from vacation until today.
