Simao files notice of suit against accounting firm

Alexandria Bay developer P.J. Simao has filed notice of his intent to sue an accounting firm that handled the books for DealMaker Auto Group LLC and 14 other companies owned by Mr. Simao.

The notice was filed Wednesday at the Jefferson County clerk’s office against Bonadio & Co. LP, Pittsford. The summons did not include an accompanying complaint outlining specific allegations Mr. Simao intends to bring against the company. The filing of both a summons and a complaint is necessary to formally begin a civil lawsuit.

According to the notice, Mr. Simao intends to bring causes of action for fraud, accounting malpractice and breach of fiduciary duty, among other causes. Mr. Simao said Thursday that the full complaint will be forthcoming.

Mr. Simao previously has contended that Bonadio was in a position to be aware of DealMaker’s financial problems, but never informed him. Mr. Simao was not involved in the day-to-day operations of DealMaker, which closed its last location in 2010.
