Watertown man charged with aggravated DWI, resisting arrest after Olmsted Drive accident

A Watertown man faces multiple charges, including aggravated driving while intoxicated, after allegedly crashing his pickup truck into a fence and shed off Olmsted Drive and then fleeing the scene on foot.

Daniel J. Mallen, 25, of 1815 Olmsted Drive, Apt. 216-B, was charged by city police just after 5 p.m. Friday with aggravated DWI, leaving the scene of a property-damage accident, resisting arrest, two counts of second-degree harassment and making an unsafe lane change.

Police said his vehicle exited the Thompson Park Circle onto Olmsted Drive at about 4:15 p.m. when Mr. Mallen lost control of the truck, causing its rear end to skid toward a yard at the Patti L. Scordo residence, 221 Park Drive E. The vehicle struck a snow bank and then a fence and a shed at the Scordo property. Police described the fence as “completely broken” and said the shed “collapsed.’

It is alleged that Mr. Mallen and a passenger, Blaine D. Durbin, 24, neither of whom was hurt, ran from the scene. Police located Mr. Mallen at his residence and charged him aggravated DWI after allegedly finding his blood alcohol content to be 0.18 percent. Aggravated DWI, which carries harsher penalties than DWI upon conviction, is charged when a motorist’s BAC is 0.18 percent or above, while the minimum threshold for DWI is 0.08 percent.

Police said that as they were arresting Mr. Mallen, he attempted to head-butt Officer George A. Cummings in the face and kicked Officer Frederick E. March in the chest, leading to the two harassment counts. Mr. Mallen is due to answer all of the charges in City Court. There was no record of Mr. Durbin’s facing any charges.
