MASSENA - Village police charged Heather M. Kirby, 26, of 92 state Route 345, Potsdam, with third-degree assault and third-degree criminal trespass following an investigation into an incident that took place at 10:53 p.m. Oct. 27 at the AmVets post on Andrews Street.
She was picked on an arrest warrant at 7:52 p.m. Wednesday by Massena-based state police and turned over to village police. She was arraigned by Norfolk Town Justice Donald Lustyik and released to reappear at a later date in Massena Village Court.
Kirby reportedly threw a beer bottle that struck the bartender, bounced and then struck a female in the face. She also reportedly failed to comply with AmVets Commander Bud Byingtons orders to leave the post.
